Welcome to The Mountain Tribe! These Terms and Conditions apply to all public services and programs provided by The Mountain Tribe. By booking or participating in any public program, you agree to the terms below.
Notice: These Terms and Conditions apply exclusively to public programs and services. If you are participating in a bespoke or custom-tailored service or program, separate Terms and Conditions will apply, which will be provided upon request or at the time of booking.
1. General Conditions
1.1. Eligibility: Our public programs are open to individuals of all ages, with specific age requirements for some activities. Minors must have permission from a parent or legal guardian.
1.2. Health and Fitness Requirements: Participants must be in good health and meet the fitness level required for outdoor activities. Each participant is responsible for assessing their suitability.
1.3. Behavior and Conduct: Participants must follow all safety instructions and respect other attendees and staff. Failure to comply may result in removal from the program without a refund.
2. Booking and Payment
2.1. Booking Process: Bookings for public programs and services can be made via our website, email, or office.
2.2. Payment: Full payment is required to confirm your booking. Payments can be made through available options such as credit card or bank transfer.
2.3. Price Changes: Program prices are subject to change. Once full payment is made, the agreed price is final and will not be affected by future changes.
3. Cancellation and Refund Policy
3.1. Cancellation by Participants:
- Cancellations made 7 days or more before the event: Full refund.
- Cancellations made 3-6 days before the event: 50% refund.
- Cancellations made less than 3 days before the event: No refund.
3.2. Cancellation by The Mountain Tribe:
In the event that The Mountain Tribe cancels a program due to weather, insufficient registrations, or other reasons, participants will be offered:
- A full refund.
- The option to transfer to a rescheduled date.
- A credit to use for future programs.
4. Program Changes and Modifications
4.1. Program Alterations: The Mountain Tribe reserves the right to modify the itinerary for safety or other unforeseen reasons. Participants will be notified of any significant changes.
4.2. Weather Policy: Programs may be adjusted based on weather conditions. If it’s unsafe to proceed, we will offer alternative activities or reschedule the program.
5. Participant Responsibilities
5.1. Safety Compliance: Participants must follow all safety instructions provided by The Mountain Tribe staff. Non-compliance may result in removal from the program without a refund.
5.2. Personal Belongings: Participants are responsible for their personal belongings. The Mountain Tribe is not liable for any loss or damage to personal items during the program.
5.3. Travel Insurance: We recommend participants have adventure (ous) travel or health insurance covering outdoor activities.
6. Liability and Waivers
6.1. Acknowledgment of Risk: Participants acknowledge the inherent risks in outdoor activities such as hiking, kayaking, and biking. By participating, you assume responsibility for these risks.
6.2. Waiver of Liability: The Mountain Tribe, its staff, and affiliates are not responsible for injuries, accidents, or damages incurred during the program, except in cases of gross negligence or misconduct.
6.3. Indemnity: By participating, you agree to indemnify and hold harmless The Mountain Tribe from any claims, damages, or expenses arising from your participation.
7. Photography and Media
7.1. Consent to Use Media: By attending our public programs, you consent to being photographed or filmed for promotional purposes. If you do not wish to appear in our media, please inform us in advance.
7.2. Personal Media: Participants may take their own photos and videos, but must respect the privacy of others. Drones or disruptive equipment require prior permission.
8. Privacy Policy
8.1. Data Collection: By participating in our public programs, you agree to the collection and use of your personal data as outlined in our Privacy Policy.
8.2. Contact Information: We may use your contact information to send program updates or promotional content. You can opt out of receiving these communications at any time.
9. Governing Law
These Terms and Conditions are governed by the laws of Viet Nam. Any disputes arising from participation in our public programs will be settled in accordance with Vietnamese law.
